Supreme Court Declares Witchcraft a legitimate religion in the United States in 1985!
What follows is a story that my wife found on the net. I want to thank her publicly for finding this story that is so much in the forefront of the Pagan community.
This story is from the following web site. http://www.celticcrow.com/community/nfedlaw.html
The WLPA Federal Law Memorandum
By WLPA Staff
Statement of the Facts: Witchcraft in the United States is a living, growing religion. As a religion, Witchcraft is protected by the Constitution. The Law has the obligation to serve and protect Witches in their religious endeavors equally as much as it protects the rights and freedoms of other groups. In the United States today, Witches are entitled to the same rights and protections as other groups under the First and Fourteenth Amendments.
ISSUE I: Is Witchcraft recognized as a legitimate religion in the United States?
ISSUE II: Does the practice of Witchcraft fall within the parameters of the First Amendment Protection clause?
ISSUE III: Are Witches entitled to rights under the equal protection clause of the Fourteenth Amendment?
ISSUE IV: Are Witches entitled to the same rights and protections under State Laws, applicable to where they live, as they are under Federal Law?

ISSUE I: Witchcraft is recognized in the United States as a legitimate religion. In 1985, Dettmer v Landon (617 F Supp 592) the District Court of Virginia pursuant to rule 52 (a) of the Federal Rules of Civil Procedure ruled that Witchcraft is a legitimate religion and falls within a recognizable religious category In most cases Federal law, even case law supersedes state law in this type of matter, the affirmation by judge Butzner clearly sets Witchcraft as a religion under the protection of constitutional rights. The Church of Wicca (or Witchcraft) is clearly a religion for First Amendment purposes.
Members of the Church sincerely adhere to a fairly complex set of doctrines relating to the spiritual aspect of their lives, and in doing so they have ultimate concerns' in much the same way as followers of more accepted religions. Their ceremonies and leadership structure, their rather elaborate set of articulated doctrine, their belief in the concept of another world, and their broad concern for improving the quality of life for others gives them at least some facial similarity to other more widely recognized religions.
While there are certainly aspects of Wiccan philosophy that may strike most people as strange or incomprehensible. The mere fact that a belief may be unusual does not strip it of constitutional protection. Accordingly the Court concludes that the Church of Wicca. Of which the plaintiff is a sincere follower. Is a religion for the purpose of the free exercise clause." Williams. J. 1985 Dettmer v. Landon Supra. ³We agree with the district court that the doctrine taught by the Church of Wicca is a religion." Butzner. J. 19864th Circuit. Dettmer v. Landon Supra.
ISSUE II: The first amendment of the United States Constitution guarantees the right to freedom of religious belief. The USCA states that a practice is a religion if it is for an individual a belief system for their whole life. The constitution does not wish to dictate what an individual should hold as a belief system or how it is practiced and will not enter into a ruling on that. "Court may not inquire into worthiness of parties' religious belief to ascertain whether they merit. First Amendment protection, but need only consider whether beliefs are 'religious' in parties' own scheme of things and whether their beliefs are sincere. USCA Const. Amend. I "To be a bona fide religious belief entitled to protection under either the First Amendment or Title VII, a belief must be sincerely held" and within the believers own scheme of things religious. USCA Const. Amend. 1: Civil Rights Act 1964 701 et seq., 717 as amended 42 USCA 2000e-16"
ISSUE III: The equal protection clause is guaranteed to all people and groups. If one group of people is entitled to equal protection than all groups are. Witchcraft is accepted as a religion, therefore, Witches are entitled to the same protections as al] other religious groups; under the equal protection clause of the Fourteenth Amendment. ³First and Fourteenth Amendments insures without qualification that a state may not forbid the holding of any religious belief or opinion, nor may it force anyone to embrace any religious belief or to say or believe anything in conflict with his religious tenets. USCA Const. Amend. 1, (14 Africa v. Anderson 542 F. Supp. 224.") (16 FPD 212-216)
ISSUE IV: USCA ARTICLE VII # 2 states: ³This Constitution, and the Laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be The Supreme Law of the Land; and the Judges in every state shall be bound thereby, anything in the Constitution or laws of any state to the

contrary notwithstanding.” In light of the fact that Dettmer v. Landon supra, being a Federally Adjudicated case. it is thereby protected by the Constitution. No state can override this Federal adjudication. No Witch can be denied his/her civil liberty and right to be a Witch, open and free, in any state in the land; within the parameters of the Law.
CONCLUSION:
· Witchcraft is a legally recognized religion in the United States and Witches are entitled to every right and protection for freedom of religion, including freedom from harassment and prejudice as every other recognized religion in the United States.
· The United States Constitution, under the First and Fourteenth Amendments. supports the right of all peoples in the United States to practice their own belief system and to enjoy this in each their own manner.
· Lawyers and Law Enforcement Agencies have the obligation to protect the rights of all people in their religious endeavors, no matter what they may be, without bias or prejudice
· Witches desire only to retain their right of religious privacy and to practice their Craft as they see fit within the parameters of the law.
A Pagan High School Needs Our Help

For years now a small group in Kentucky have been fighting to keep the most historical building in the area as well as the only Pagan High School in the country that gives basic education requirements and more.
When it was purchased it was planned to make a sanctuary and private school for all who needed an education and a home without fear of persecution.
Now, five years later, with the bottom floors almost complete and work on the second began, Politics in the area changed and the attacks began, a Federal Law suit was filed for their discrimination and violation of constitutionally protected rights.
This has continually depleted the funds of the core group and now the building is in desperate need of a roof and additional legal fees. We intend to fight for our right to worship as we please as well as our kids to be allowed to see their creator as they please. Opinion:
Pagan double standards
By Lone Wolf
If any of you readers have noticed? The Pagan philosophy is to have compassion and understanding for all living things.
If you are active in your Coven or Organization and you have a mental disorder or physical disorder you will know what I am writing about.
Anybody that is in charge of an activity that is “normal” physically or mentally looks at you as a liability and not an asset.
It has been observed that the people of somewhat superior intelligence and physical ability tend to look down on persons with mental and physical disabilities.
There is no solution to this problem nor is there a plausible reason for such actions! It is a deplorable violation of Pagan Ethics to have a double standard in the Pagan community! Personally this action should be punishable by equal treatment of these superior individuals. However due to the Pagan ethics and Karma this cannot be done. These disabled persons should not have to have a spotlight on them for any reason for if you are observant you will know who these people are.
There are a large number of people in the Pagan community that are disabled in one form or another.
There are also an equal number of Pagans that are of superior intelligence and physical ability!
These actions remind me of how conservative thinking people think about the homeless? Such as (I am quoting here) homeless are bums and have no place in the community, the homeless want to be homeless, all the homeless are is drunks and so on.
It does not take a genius to figure out the some people with disabilities are a valuable asset to any organization. To the people that know what I am talking about this is nothing more than character assignation on a mammoth scale in the Pagan community.

Knot Spell
To rid you of problems or a troublesome situation.
Take cotton yarn in the appropriate color of the problem (green for money, red for love, etc) and pour out your fears and problems in to the yarn. Tie it up in knots to symbolize how "tied-up" you feel. Take it outside and let the wind blow it away along with your negativity. Go back inside and take a ritual bath or shower cleansing.

CHOOSE TO BE HAPPY...........CHOOSE DAMIANA
A thousand years ago, if you went to the village Witch and asked her for a love spell to enchant someone, she would have given you Damiana.
Today slipping something into someone else's beverage is ill advised, but that doesn't mean that you cannot enchant yourself and become enchanting to everyone around you!
Damiana will give you that contentment; I am in love feeling, no matter what your circumstances. Most people are very happy when they feel that way. Being happy and contented makes us very attractive to others in all of our relationships. And it is fast. Two capsules on an empty stomach will make the worst blues go away in 20 minutes. Of course, it takes a little longer if you have recently dined, but it will still work wonderfully.
You may choose to take it every day, as I do, or you may choose to take it for specific reasons. The boss just yelled at you and if you want to remain employed, you better not yell back? Have some Damiana capsules in your desk drawer. Take a couple and a little walk and when you get back, you will understand that it was really about the bad day the boss was having. You will feel great!
Damiana is great for men and women, but it has a couple of extra special applications for ladies. Do you suffer from PMS? Take one capsule, 3 times a day from the first cranky feeling and you will level right out. Same for the mood swings that can be associated with Menopause or Peri-Menopause. Damiana just makes the sad and the cranky dissolve. Don't suffer needlessly. Call on this natural wonder to help you love yourself and love your world.
Put a spell on yourself! You will be glad you did!

How to read a Crystal Ball
Darken the room around you. Put the crystal ball on a dark surface that will not reflect any light that will distract you. Have a candle or other form of light shining into and illuminating the ball. The light source can be reflecting up inside the crystal ball stand or behind the crystal. It can also be shining from behind you into the crystal ball.
Sit comfortably with your spine straight. Keeping your spine straight enables you to channel all the energy that comes through your body when you do your readings. Ground yourself and calm your mind.
Clear the crystal before using it.
Then charge it using this method:
Hold the crystal ball and rub it with both hands. Then set it back on its stand while still maintain your focus. Next point a single-terminated quartz crystal or a crystal wand towards the ball at a distance where you most comfortably feel the two connect. When you feel or sense the subtle connection between the crystal and the ball, begin to circle the single-terminated crystal in a clockwise direction. Maintain the connection between the crystal and the ball. Soon you will feel the
crystal ball pulsate. When you feel it pulsating strongly you can lay your
single-terminated crystal or crystal wand down and begin the next step.
Diffuse your vision.
Find a spot in the ball the interests you. Bring all your attention to that spot. Now look at it in more detail. Allow your intellectual mind to relax. Leave yourself open to any impressions. Don't have any preconceptions. Have no judgments. Remain relaxed, open and focused. Now look at that area in still more detail. As you look at this area even more closely you may find yourself tensing. If so, take a deep breath and relax as you let it out. Continue to do this until you release the tension.
Continue to gaze into the particular area, seeing more and more detail. As you look at this minute detail the crystal ball seems to become larger. The more you lose your sense of yourself and are only conscious of the detail in the crystal space, the larger the ball seems to become. As you are looking, feel yourself opening as if you have no edges or boundaries. Allow yourself to lose your awareness of yourself and just be aware of the crystal ball.
Your eyes may or may not close at this point. If they feel like closing, let them close and continue to feel as if the crystal is around you. If your eyes remain open, still feel as if you’re inside the crystal. Whether your eyes are open or closed a point is reached where there is no difference between you and the crystal. There is only crystal and just what you are seeing. You are now in an altered state of consciousness or trance state.
You may at this point find yourself feeling compelled to do something. This may be to breathe in certain ways, move energy in a particular pattern in your body, or to work with the crystal in a different manner. Trust yourself and let this compulsion guide you. Your body may almost involuntarily assume different positions. Let it. You may find yourself making sounds. Feel free to allow this to happen. At the same time there is no necessity to force it to happen. Successful crystal ball reading doesn't depend on any of these occurrences.
Now either ask specific questions in your mind or use your will to guide you to specific locations that you mentally view. If you haven't a specific question, mentally refer to your more general purpose in crystal reading at the time. Then let impressions come and go. Don't hang onto them but communicate them to another or out loud into a tape recorder. Let the impressions flow through you. Continue to communicate what you see until you have a feeling of being finished.
When you are through, remain with the crystal for a few minutes. Release any tension. You will feel a sensation of floating inside the crystal ball. Varied impressions may come and go. Just watch them pass. In this space are all possibilities, all assistance, all knowledge, and all wisdom.
Now, after enjoying this space for a while, slowly begin to back out of the ball. Start to feel edges around yourself while you continue to gaze. Have a feeling of backing up as you become more aware of the edges around the ball. If you followed a certain route into the ball, retrace it. Continue until you see the ball in front of you. Become aware of the surface on which you sit. Be aware of your breathing. If your eyes are open, let go of the diffused vision and bring it back to normal. If your eyes are closed, slowly open them. Now stretch and shake yourself a little until you feel completely in your everyday consciousness.
Ground yourself. Next, clear your crystal ball, the other single-terminated crystal or crystal wand, yourself, and the room you are in.
If you like, cover your ball with cloth or put it in a pouch. Store it in a special place.

Teen Prospective
For the past four years I have enjoyed volunteering for the Christmas mini mall seeing the faces of mini excited and happy children. About 200 children come to the mini mall to see the same old jolly Santa and to taste those good old Christmas cookies. Well, this past year I decided to bring my boyfriend Daniel to feel the joy I feel every year helping families have a Christmas they just might not of had with out our help. Me, Daniel, and my two other friends woke up early on a Saturday ready to play as elves, knowing its all worth waking up early on a Saturday just to see many children walk through that door with smiling faces ready to sit on jolly old Santa’s lap and to meet his wonderful little helpers; Kimberly, Daniel, Brandon and Krystopher. It was great. We only have one chance every year to volunteer at the mini mall, one chance to feel like you get to have two Christmases every year. It’s like you have one huge family to share the same great joy with, the family that grows every single December. (Thank you to every one that volunteered at the mini mall, for sharing that special joy that I never knew I could have.) Now I pass that joy down to my friends that now help me at mini mall and this past year my friend Brandon passed down to his friend Krystopher. I hope there are many more volunteers to come every year, to feel this joy that they might of never felt before.

Pagan Holidays
Family Ostara
By Raven Silverwing
Ostara, also known as The Spring or Vernal Equinox, the Festival of Trees, Alban Eilir, Ostara, the Rites of Spring, and the Rites of Eostre, occurs between March 19 and 21 and marks the first day of true Spring. Day and night are equal on this day, hence the name Equinox. Pagans observe it throughout the world. For Wiccans and Witches, Ostara is fertility festival celebrating the birth of Spring and the reawakening of life from the Earth. The energies of Nature subtly shift from the sluggishness of Winter to the exuberant expansion of Spring. The Saxon Goddess of fertility, Eostre, and Ostara the German Goddess of fertility are the aspects invoked at this Sabbat. Some Wiccans traditions worship the Green Goddess and the Lord of the Greenwood. The Goddess blankets the Earth with fertility, bursting forth from Her sleep, as the God stretches and grows to maturity, He walks the greening fields and delights in the abundance of nature.
At our house, Ostara marks the beginning of outdoor fun. If weather permits, have your celebration outside! It is also a good time to start planting seeds and seedlings. Kids love getting their hands in the dirt and helping out. Here is a ritual that you can incorporate into your planting.
· Decorate the altar with fresh flowers. Set up the altar with your usual tools and include a potted plant or seeds to be planted in some dirt and the cauldron with water and flowers. Light the candles and the incense. Cast your circle. After invoking the Gods, face east and everyone gaze at the plant. Explain that it not only is a plant but a symbol of the awakening Earth.
· Say:
Blessed is the Goddess, our Mother, our provider. Now the dark days of winter have passed and the world grows greener again. As life awakens from its slumber and is renewed by the power of the God and Goddess, we thank them for all we have received from them. **You can add any other words you wish**
· Everyone touch the plant to connect with its energies; feel its life. When ready,
· Say:
· This plant is representative of awakening of life after its long winter slumber. May we learn to be kind to all creatures, great and small, and may we bear in our hearts a warmth and understanding of all living things. Mother Goddess, Father God, teach us to revere the Earth and all its treasures always.
· Plan ahead magick and seasonal activities, like decorating eggs. Hold a simple feast and close the circle when ready.
Some activities to do together:
· Wear green clothing.
· Have a breakfast of buns, ham and eggs. Save the shells. Throw the shells into your garden or anywhere outside and say: "For fairy, for flowers, for herbs in bowers, the shells pass fertility with springtime showers."
· Color hard boiled eggs with dye or paint. Empower one of a specific color of a goal you wish to obtain. Eat the eggs and feel yourself being blessed.
· Make Hot Cross buns to honor the union of the Earth and the Sun for Spring.
· On Ostara Eve, light a purple candle and burn patchouli incense. Carry them both through the house and say: "Farewell to wintry spirits and friends; on marrow we greet the spirits of spring. Ostara - {Vernal Equinox} Around March 20th
· American and Celtic traditions ~ Ostara
· Caledonii traditions ~ Alban Eiler
This festival celebrates the warrior aspect of the God and the Goddess as the Maiden. It occurs in the middle of March when the length of day is equal to the length of night. It is a time of balance, the official end of winter and beginning of winter. The second of the fertility festivals, Ostara represents the seeding and preparation for the remainder of the year.
Blessing seeds for future plantings celebrate the season. Eggs are colored and placed on an alter as magical talismans. The "Easter Bunny" and "Easter Baskets" are both variations of this Pagan festival. The Bunny represents abundance of planting yet to come and the baskets are used to gather the new spring flowers, another representation of fertility. After all, blossoms are a culmination of combining masculine pollen with feminine pollen. What a better representation of fertility.
The season is also represented by light green, lemon yellow and pale pink. The beginning colors of maturing plants and flowers. Twisted bread and sweet cakes are prepared and served at dusk to represent the abundance of planting for the new harvest.

Best done during the full moon

Our blessings to thee as your way you wend; and merry we'll meet next winter again." Blow out the candle and say: "Merry meet, merry part, and merry meet again."
· Spring-cleaning - Clear out old clothes, books, toys etc. Donate used items or recycle!
· Wake up before sunrise and watch it together.
